ACCEPTANCE OF TERMS

These Terms and Conditions (“Terms”) govern all services provided by Jamie Pickering at With Jamie LTD (“withjamie”, “we”, “us”, “our”), a company registered in the United Kingdom, to any client (“you”, “Client”). By commissioning services, accepting a quotation, or paying any invoice (including a deposit), you agree to be legally bound by these Terms. Payment of a deposit constitutes acceptance and forms a binding contract. If you do not agree, you are expressly prohibited from using the services, and you must discontinue use immediately.

SERVICES

We provide creative digital services, including, but not limited to:

  • Website Design 
  • Social Media Management
  • Content Creation
  • Copywriting
  • Branding & Identity

Services are provided on a project or retainer basis as agreed in writing. 

The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access the Services from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.

The Services are not tailored to comply with industry-specific regulations (Health Insurance Portability and Accountability Act (HIPAA), Federal Information Security Management Act (FISMA), etc.), so if your interactions would be subjected to such laws, you may not use the Services. You may not use the Services in a way that would violate the Gramm-Leach-Bliley Act (GLBA).

CLIENT ELIGIBILITY

We provide services to both individuals and businesses. You confirm that you have legal capacity to enter into this agreement.

FEES, DEPOSITS, AND PAYMENT

  • A 50% deposit is required upfront unless otherwise agreed.

  • Work will not commence until the deposit is received.

  • Remaining balances are payable within 30 days of invoice.

  • Late payments may result in paused work or termination.

  • Fees are non-refundable once work has commenced.

SCOPE OF WORK & REVISIONS

  • Scope is defined in the agreed proposal or quotation.

  • Included revisions are limited to 1–3 rounds unless otherwise stated.

  • Requests outside scope constitute additional work and will be quoted separately.

CLIENT RESPONSIBILITIES

As a client, you agree:

  • You have the power to enter contract on behalf of your organisation

  • To provide everything needed to complete projects

  • To review work, provide feedback and sign off within agreed timescales

  • To ensure you own or have rights to all materials supplied.

  • To acknowledge delays caused by you may affect timelines.

INTELLECTUAL PROPERTY

Ownership

All intellectual property remains the property of With Jamie LTD until full payment is received. This includes all databases, website designs, functionality, software, source codes, audio, video, text, photographs, and graphics in the Services (collectively, the ‘Content’).

Upon full payment, you receive a licence or ownership as specified in writing, excluding:

  • Pre-existing tools, frameworks, templates, and methodologies

  • Reusable design or technical components

Reuse & Portfolio Rights

Unless you explicitly request otherwise in writing:

  • We may display completed work in our portfolio, website, and marketing.

  • We may reuse non-client-specific templates, structures, and systems.

Except as set out explicity in these Terms, no Content or Marks may be copied, aggregated, republished, posted, reproduced, uploaded, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

If you wish to make use of the Services, Content or Marks, please address your request to: jamie@withjamie.co.uk. If we ever grant you permission to post, reproduce or publicly display any part of our Services or Content, you must identify us as the owners or licensors.

CONFIDENTIALITY

Both parties agree to keep confidential information private unless disclosure is required by law.

By sending us Submissions through any part of the Services (such as the Contact Form), you confirm that your Submissions do not constitute confidential information. 

PROHIBITED ACTIVITIES

You may not access or use the Services for any purpose other than that for which we make the Services available. The Services may not be used in connection with any commercial endeavours except those that are specifically endorsed or approved by us.

As a user of the Services, you agree not to:

  • Systematically retrieve data or other content from the Services to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
  • Trick, defraud, or mislead other users and us, especially by attempting to obtain sensitive account information, such as user passwords.
  • Circumvent, disable, or otherwise interfere with security-related features of the Services, including features that prevent or restrict the use or copying of any Content or enforce limitations on the use of the Services and/or the Content contained therein.
  • Disparage, tarnish, or otherwise harm, in our opinion, us and/or the Services.
  • Use any information obtained from the Services in order to harass, abuse, or harm another person.
  • Make improper use of our support services or submit false reports of abuse or misconduct.
  • Use the Services in a manner inconsistent with any applicable laws or regulations.
  • Engage in unauthorised framing of or linking to the Services.
  • Upload or transmit (or attempt to upload or to transmit) viruses, Trojan horses, or other material, including excessive use of capital letters and spamming (continuous posting of repetitive text), that interferes with any party’s uninterrupted use and enjoyment of the Services or modifies, impairs, disrupts, alters, or interferes with the use, features, functions, operation, or maintenance of the Services.
  • Engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools.
  • Delete the copyright or other proprietary rights notice from any Content.
  • Attempt to impersonate another user or person or use the username of another user.
  • Upload or transmit (or attempt to upload or to transmit) any material that acts as a passive or active information collection or transmission mechanism, including without limitation, clear graphics interchange formats (‘gifs’), 1×1 pixels, web bugs, cookies, or other similar devices (sometimes referred to as ‘spyware’ or ‘passive collection mechanisms’ or ‘pcms’).
  • Interfere with, disrupt, or create an undue burden on the Services or the networks or services connected to the Services.
  • Harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any portion of the Services to you.
  • Attempt to bypass any measures of the Services designed to prevent or restrict access to the Services, or any portion of the Services.
  • Copy or adapt the Services’ software, including but not limited to Flash, PHP, HTML, JavaScript, or other code.
  • Except as permitted by applicable law, decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Services.
  • Except as may be the result of standard search engine or Internet browser usage, use, launch, develop, or distribute any automated system, including without limitation, any spider, robot, cheat utility, scraper, or offline reader that accesses the Services, or use or launch any unauthorised script or other software.
  • Use a buying agent or purchasing agent to make purchases on the Services.
  • Make any unauthorised use of the Services, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretences.
  • Use the Services as part of any effort to compete with us or otherwise use the Services and/or the Content for any revenue-generating endeavour or commercial enterprise.
  • Sell or otherwise transfer your profile.
  • Engage in unlawful, fraudulent, deceptive or misleading activities
  • Use deliverables for spam, scams, phishing, or other abusive or unethical practices
  • Attempt to exploit, reverse engineer, resell, or redistribute work outside the agreed scope
  • Pressure or request withjamie to produce content that violates professional standards or applicable laws

TERMINATION

Either party may terminate with 30 days’ written notice. Upon termination:

  • All outstanding fees become immediately payable.

  • Work completed up to termination will be billed.

  • Deposits remain non-refundable.

CONTRIBUTION LICENSE

You agree that we may access, store, process, and use any information and personal data that you provide.

By submitting suggestions or other feedback regarding the Services, you agree that we can use and share such feedback for any purpose without compensation to you.

DISCLAIMER

The Services are provided on an “as is” and “as available” basis and are used entirely at your own risk. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including (without limitation) implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee any specific results or outcomes from the Services, including (without limitation) search engine rankings, traffic levels, conversions, revenue increases, or any other business, financial, or commercial results. Any projections, examples, or estimates discussed are indicative only and do not constitute a promise or guarantee.

We make no representations or warranties regarding the accuracy, completeness, or reliability of the Services or any content made available through them, including content on any third-party websites or applications linked to the Services. We accept no liability for: (a) errors, omissions, or inaccuracies in content; (b) any loss, damage, personal injury, or property damage arising from your use of the Services; (c) unauthorised access to or use of servers or stored data; (d) interruptions or cessation of service; (e) bugs, viruses, or other harmful components transmitted by third parties; or (f) any loss or damage resulting from reliance on content made available via the Services.

We do not endorse, warrant, or assume responsibility for any third-party products or services advertised or linked through the Services, and we are not responsible for monitoring or being party to any transactions between you and third-party providers. You are responsible for exercising your own judgement and caution when engaging with third-party content, products, or services.

LIMITATION OF LIABILITY

To the fullest extent permitted by law:

  • We are not liable for indirect, consequential, or economic loss.

  • Total liability is capped at the fees paid in the preceding 3 months.

Nothing limits liability for death, personal injury, or fraud.

INDEMNITY

You agree to indemnify us against claims arising from and against any loss, liability, claim, damage or demand due to or arising out of:

  • Content you provide

  • Breach of these Terms

  • Misuse of deliverables

THIRD-PARTY SERVICES

We are not responsible for third-party platforms, plugins, hosting providers, or tools used in delivering services.

Services may contain links to other websites as well as articles, text, graphic,s photographs, designs, music, sound, video, information, applications, software, and other content or items belonging to third parties. Such Third-Party Websites are not investigated, monitored, or checked for accuracy, appropriateness, or completeness by us, and we are not responsible for any Third-Party Websites accessed through the Services, our website or otherwise. Any purchases you make through Third-Party Websites will be through other websites and from other companies, and we take no responsibility whatsoever in relation to such purchases, which are exclusively between you and the applicable third party. You agree and acknowledge that we do not endorse the products and services offered by these Third-Party Websites.

DATA PROTECTION & PRIVACY

Use of our services is subject to our Privacy Policy. We process personal data in accordance with UK GDPR.

FORCE MAJEURE

We are not liable for delays caused by events beyond reasonable control.

GOVERNING LAW

These Terms are governed by the laws of England and Wales.

DISPUTE RESOLUTION

Disputes will first be resolved through informal negotiation for at least thirty (30) days. If unresolved after this period, disputes shall be referred to binding arbitration seated in London, UK, conducted in English.

CORRECTIONS

There may be information on the Services that contains inaccuracies, typographical errors, or omissions, including descriptions, pricing, availability, and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Services at any time, without prior notice. 

AMENDMENTS

We may update these Terms at any time. Continued use of services constitutes acceptance of revised Terms. It is your responsibility to regularly revisit our Terms & Conditions.

MISCELLANEOUS

Our failure to exercise or enforce any right or provision of these Legal Terms shall not operate as a waiver of such right or provision. These Legal Terms operate to the fullest extent permissible by law. We shall not be responsible for any loss, damage, delay or failure to act caused by any cause beyond our reasonable control. If any part of these Legal Terms is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Legal Terms and does not affect the validity or enforceability of any remaining provisions.

Overview

Northshore Dental is a modern private dental clinic offering general and cosmetic dental services. Here, I created a Home Page design focusing on calls to action and building trust.

Solutions

The brief emphasised reassuring nervous clients and creating the impression of a comforting, relaxing dental studio. The main goal was to build trust and funnel that into increased bookings. To do this, I used neutral colours and minimalist visual elements and typography to avoid feeling overly clinical or daunting.

Final Outcome

The homepage provides reassurance to patients and focuses on the appointment booking CTA. The calming design helps address Northshore’s challenge of earning client trust.

Overview

The Personalised Flower Box is a local florist. Pauline discussed wanting to grow her audience as she moved towards a new niche. Her focus was on showcasing her personality, which we achieved through static and video content I produced.

Process

Pauline provided me with static content, which I edited and adapted to align with her relevant strategy. These were posted twice a week across Facebook and Instagram.

Simultaneously, I produced and edited long-form video content for Pauline, which was posted on YouTube and gained traction with the second video, with clients noting it was useful and entertaining.

Results

Pauline saw significant growth across her social media platforms. Increased engagement and reach on Instagram and Facebook led to more traffic to her website, and Pauline noted a noticeable increase in sales and enquiries.

Tutorials posted on YouTube helped attendees of her workshops understand wreath making, making classes smoother, more efficient, and more engaging.

Overview

During lockdown, I created a themed Instagram account. It was a growing, competitive niche, so I had to learn how to adapt to the community and its expectations. What began as a hobby turned into a thriving community and business that lasted just under half a decade.

Results

In just 12 months, I grew this account to over 100,000 followers, reaching 150,000 only a few months later. At its peak, my daily posts were receiving up to 75,000, and the page was attracting more than 1 million monthly visitors.

I am incredibly proud of the community I created. I hosted giveaways, developed a merch line, partnered with brands for paid advertisements and received hundreds of messages from people sharing what the page meant to them. 

In January 2024, I took the step to stop posting. Rather than selling the account, despite receiving several strong offers, I decided to leave the page as a digital time capsule that people, including myself, can return to forever. 

This project is one of my favourite examples of what good strategy, consistency, and creativity can achieve. It’s also the basis of the work I do for clients: helping them to build brands, content and communities that genuinely resonate and grow.

Overview

ClearLedger is a speculative modern accounting platform for non-finance founders who don’t understand traditional accounting tools. Here, I was tasked with Home Page design, focusing on visual hierarchy, calls to action and building trust.

Solutions

I prioritised ensuring the site didn’t feel daunting or too corporate by using minimalistic colouring and typography. White and light blue create a fresh, sleek feel.

I focused on CTAs to align with the main goal of increasing free-trial signups among first-time visitors. Furthermore, this goal made trustworthiness and credibility paramount, which I ensured through social proof and human support cues. 

Final Outcome

The homepage communicates trust and reliability, making the daunting topic of finances more accessible for non-finance founders.

The Personalised Flower Box

Overview

Pauline Brunsdon, at The Personalised Flower Box, expressed a desire to rebrand her business ahead of opening an E-Commerce store and YouTube channel. The existing visuals of her website were inconsistent and unclear, making for a difficult user journey and experience and failing to communicate value quickly.

Solutions

To solve these issues, I began by designing a sleek yet on-theme logo, as well as a smaller version for the favicon and social media profile pictures. I composed set typography and colour schemes to use across platforms, creating a more cohesive and recognisable brand identity.

Refining the User Experience and Interface (UX/UI) improved professionalism and built trust from a visitors first impression. Furthermore, a cleaner structure made browsing faster, easier and more enjoyable.

Final Outcome

Pauline was delighted with her new website and branding. Post-launch, she saw an increase in engagement across her website and social media platforms. This has led to an ongoing collaboration for social media and website management.
